Jobs and meeting requests

  1. Minimum job fee is $150 + GST.
  2. Meeting cancellations received with less than 24 hours notice incur a fee of $150 + GST.

Payment

  1. A 50%-100% deposit is required prior to work commencing, with the balance payable on completion. Any additional charges incurred during the project are due within 7 days of invoice.
  2. Ownership of all work created by The Yard Creative Pty Ltd transfers to the client upon receipt of full payment. Use of any work prior to full payment being received infringes Australian Copyright Law.
  3. Invoices are due within 7 days of the invoice date. Overdue invoices may incur a late payment fee of 5% per month on the outstanding balance.
  4. No refunds.

Quotes

  1. Quotes are valid for 30 days from the date of issue.
  2. Quotes are based on the client supplying all copy (sub-edited and ready for use) and image content as high-resolution files.
  3. Quotes include two rounds of revisions. Additional revisions are charged at $150/hr + GST, billed in 15-minute increments.
  4. Changes to quantities, product specifications, or approved artwork will incur additional charges.
  5. All prices exclude domain name registration, hosting, printing, and delivery costs unless otherwise stated.

Approvals

  1. Approving your artwork or digital work confirms your agreement to the design and all content.
  2. By approving your artwork or digital work, you accept full responsibility for any errors, omissions, or discrepancies present at the time of approval, and you release The Yard Creative Pty Ltd from all related liability.
  3. Approving print-ready artwork also releases The Yard Creative Pty Ltd from liability for any errors arising from print production when you have sourced your own printer or manufacturer.

Pay per click and social media advertising

  1. All pay per click (PPC) and social media advertising costs are the responsibility of the client and will be invoiced directly via Google Ads, Microsoft Ads, or the relevant social media platform.

Websites and website maintenance

  1. Website design and development costs do not include ongoing or routine maintenance and updates. After final website approval, all updates are invoiced at $150/hr + GST. We strongly recommend a minimum of one hour of monthly maintenance.
  2. Website login credentials are the sole responsibility of the client. We strongly recommend a strong password using a combination of upper case, lower case, numeric, and symbol characters that is not known to others.
  3. You acknowledge and agree that The Yard Creative Pty Ltd is not liable for the actions of hackers, viruses, or other security threats arising from conducting business online. It is the client’s responsibility to back up their website and ensure data integrity. Where a website build is included in the Services, The Yard Creative Pty Ltd will install and schedule appropriate backup software at the time of launch. The client agrees to release and hold harmless The Yard Creative Pty Ltd from any liability for loss of sales, leads, or reputation arising from security issues.
  4. Removal of the footer design credit included in any website build incurs a one-off fee of $990 inc GST.
  5. Website projects not completed within 6 months of the first proof being supplied, due to the client failing to communicate or respond, are liable to incur a project restart fee of $550 inc GST.

Client-supplied content

  1. The Yard Creative Pty Ltd accepts no responsibility for errors, inaccuracies, or legal issues arising from content supplied by the client, including text, images, logos, or other materials. The client warrants that all supplied content is accurate and that they hold the rights to use it.

Intellectual property

  1. All original concepts, designs, and working files created by The Yard Creative Pty Ltd remain the property of The Yard Creative Pty Ltd until full payment has been received.
  2. Upon receipt of full payment, the client is granted full ownership of the final agreed deliverables. Working files, source files, and unused concepts remain the property of The Yard Creative Pty Ltd unless their transfer is agreed in writing.

Governing law

  1. These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or the services provided will be subject to the exclusive jurisdiction of the courts of New South Wales.

 

These terms are final and non-negotiable.
